AfAA Announces Winners of Paper Awards - Anthropology News

This year, the AfAA Graduate and Undergraduate Award Committees received a number of strong submissions for both the Bennetta Jules-Rosette Graduate Paper Award and the Nancy (?Penny?) Schwartz Undergraduate Paper Award.?Many of the papers were excellent.

Bennetta Jules-Rosette Graduate Paper Award

The graduate award winner is George Paul Meiu (Department of Anthropology, U Chicago) for ?Beach-Boy Elders and Young Big Men: Queering the Temporalities of Aging in Kenya?s Ethno-Erotic Economies.? Meiu is an accomplished young scholar, who has already published a number of articles during his graduate career.?His innovative award submission uses an African example to tackle global issues of sexuality, ethnicity and aging.?Meiu sheds ethnographic light on issues that often remain hidden within Africanist discourse. He emphasizes the role of African masculinity within colonial and postcolonial imaginations, and he insightfully analyzes the ways in which these discourses shape contemporary networks of tourism and sexual trafficking. Case studies are drawn from the Maasai ?Mombasa Morans? and their participation in sexual tourism. The paper comes highly recommended by Professor Jean Comaraff (U Chicago).?Meiu will receive the $500 award stipend and travel funds to attend the Annual AAA Meetings.

Honorable Mention goes to Mohamed Abumaye (Department of Sociology, UC San Diego), who has written a highly original paper on the role of oral history in cultural change entitled ?Silenced into Non-Existence: Living History of Somali Orality.??His paper examines the myths and oral history accounts surrounding the story of Empress Arrawelo in Somalia. The paper demonstrates the permutation of the Arrawelo account from its traditional format to contemporary, postmodern rap versions.??The paper contains a critique of the work of IM Lewis on the Arrawelo myth, as well as theoretical discussions based on the work of Michel Foucault, VY Mudimbe, and Jacques Depelchin.?Supplemental funds from UC San Diego?s African and African-American Studies Research Center will provide for Mohamed Abumaye?s attendance of the AAA meetings in San Francisco.

Nancy (?Penny?) Schwartz Undergraduate Paper Award

The winner by unanimous acclaim is Divya Bhat (International Studies, UC San Diego) for her senior honors thesis entitled ?Survival Strategies as Islands of Security: Social Change and Development in the Congo.??The thesis addresses theories of governance and development in Congo DRC in relationship to survival strategies adopted by communities and individuals throughout the country.??A focus is placed on case studies of family units, religious movements, the informal sector and the diamond trade, and youth culture.??Each of these case studies is employed to demonstrate the resiliency of the Congolese people in the face of the disintegration of the national government and formal institutional and social networks.?The thesis was awarded highest honors at the UC San Diego.?This is Divya?s second award submission to the AfAA.??In 2011, she received an honorable mention for her research on child witches in the Congo.?Divya relies on the research of Rene Devisch and Filip De Boeck in scaffolding her argument.?Divya will be unable to attend the San Francisco meetings as she has recently entered the graduate program in Anthropology at the University of Amsterdam.?Divya will receive a $100 award stipend.

Courtney Dehn-Gurbacki (International Studies, McGill U) receives an honorable mention for ?The Mediation of Large-Scale Farmland Deals: A Tanzanian Case Study.??This excellent senior honors thesis in International Development Studies incorporates anthropology within a wider interdisciplinary and applied framework. Dehn-Gurbacki examines the process of land acquisition in Tanzania and the development of large-scale commercial agriculture.??She effectively balances global and local concerns by focusing on the cultural practices and processes of land acquisition and allocation. The thesis presents a number of Tanzanian case studies and builds upon primary fieldwork in Tanzania, Kenya, and Uganda.??She bases her research on the work of Olivier De Schutter as well as a number of reports from international agencies, including the World Bank and various nongovernmental organizations.?Long-term AfAA members John Galaty and Karen McAllister served as advisors for the project.

Manage Context Menu items with Right Click Enhancer

If you install lots of software on your system you may have noticed that the Windows Explorer right-click context menu has grown considerable in size ever since you started to install software on your computer. Many applications add their own items to the context menu which help you run specific features faster. You can for instance send a selected file directly to your virus scanner for testing, or load selected media files with your favorite media player.

It quickly becomes a problem once items are added that you do not use at all. The result is a cluttered context menu that is displaying too many items and slowing you down as a consequence.

Right Click Enhancer is a free portable software program for the Windows operating system that makes available a set of tools to tame the context menu. The program not only lets you remove items with ease, it also enables you to add useful items or program shortcuts to the context menu.

The program displays a number of options on start which may be confusing at first. There is for instance a right click editor and a simple right click editor, and it is not really clear what the difference is between the two tools. Here is a quick rundown of all tools and the functionality they make available:

  • Right Click Editor IE ? You can edit Internet Explorer?s context menu here.
  • Send To Manager -? Add or remove devices, folders or services in the Send To folder.
  • New Menu Editor ? Add or remove files that you can create when you select the New option in Windows Explorer.
  • Simple Right Click Editor ? Displays context menu commands and their actions. You can use it to remove actions from the menu.

'Argo' finally tops box office with $12.4M

LOS ANGELES (AP) ? It took three weeks, but "Argo" finally found its way to the top of the box office.

The Warner Bros. thriller from director and star Ben Affleck, inspired by the real-life rescue of six U.S. embassy workers during the 1979 Iranian hostage crisis, made nearly $12.4 million this weekend, according to Sunday studio estimates. "Argo" had been in second place the past two weeks and has now made about $60.8 million total.

Debuting at No. 3 was the sprawling, star-studded "Cloud Atlas," which made a disappointing $9.4 million. The nearly three-hour drama, also from Warner Bros., was co-directed by siblings Lana and Andy Wachowski and Tom Tykwer and features an ensemble cast including Tom Hanks, Halle Berry and Hugh Grant playing multiple roles over six story lines.

Dan Fellman, head of distribution at Warner Bros., said the studio thought there might be a good chance of "Argo" coming out on top this weekend.

"We're thrilled. An accomplishment like that is well deserved, they don't happen very often. You would probably have to do a lot of searching to find a movie that opened in wide release to have two No. 2 weekends in a row and hit No. 1 in the third week," Fellman said. "It's a tribute to the film. Word-of-mouth has taken over the campaign. We have a long way to go, we have a lot of year-end accolades which will approach, and we'll see what happens in terms of the Academy."

On the flip side, Fellman acknowledged that "Cloud Atlas" underperformed compared to hopes that it would end up in the $11-12 million range domestically. The movie had an estimated budget of $100 million. But he pointed out that it had a higher per-screen average than any other film opening in the top 10 with $4,681.

"We did very well on the East and West coasts in a number of major cities," he said. "We're challenged in the Midwest and the South."

It was a soft weekend all around, though, with several newcomers opening poorly, Hollywood.com box-office analyst Paul Dergarabedian pointed out. The horror sequel "Silent Hill: Revelation 3-D" from Open Road Films debuted at No. 5 with $8 million and the Paramount Halloween comedy "Fun Size" arrived in 10th place with just over $4 million. "Chasing Mavericks," an inspirational surfing drama from Fox 2000, didn't even open in the top 12 ? it came in at No. 13 with $2.2 million.

The World Series might have been a factor in keeping folks away from the theaters; also, potential moviegoers along the East Coast in the path of Hurricane Sandy might have stayed home this weekend.

"The whole marketplace felt more like September than October. Back in September, we had four down weekends in a row. There was no momentum in the marketplace," Dergarabedian said. "When a holdover is No. 1, it reflects a lack of strength in the marketplace. Every week should have a new movie topping the chart."

As for the philosophical, centuries-spanning "Cloud Atlas," he said: "To have a) a big budget, b) Tom Hanks and c) it's a big, epic film, it doesn't necessarily follow that it's going to be a big box office hit. I admire that they went for it."

But there's hope on the horizon with the animated comedy "Wreck-It Ralph" coming next weekend, the latest James Bond film, "Skyfall," opening Nov. 9 and the final installment in the "Twilight" saga due out Nov. 16. "Skyfall" opened this weekend overseas with a whopping $77.7 million in 25 countries.

"This is just one of those box office weekends we'd rather forget," Dergarabedian said. "Unless you're 'Argo.'"

Estimated ticket sales are for Friday through Sunday at U.S. and Canadian theaters, according to Hollywood.com. Where available, latest international numbers are also included. Final domestic figures will be released Monday.

Poll: Scant demand for Microsoft's Windows 8

(AP) ? Microsoft bills Windows 8 as a "re-imagining" of the personal computer market's dominant operating system, but the company still has a lot of work to do before the makeover captures the imagination of most consumers, based on the results of a recent poll by The Associated Press and GfK.

The phone survey of nearly 1,200 adults in the U.S. found 52 percent hadn't even heard of Windows 8 leading up to Friday's release of the redesigned software.

Among the people who knew something about the new operating system, 61 percent had little or no interest in buying a new laptop or desktop computer running on Windows 8, according to the poll. And only about a third of people who've heard about the new system believe it will be an improvement (35 percent).

Chris Dionne of Waterbury, Conn., falls into that camp. The 43-year-old engineer had already seen Windows 8 and it didn't persuade him to abandon or upgrade his Hewlett-Packard laptop running on Windows 7, the previous version of the operating system released in 2009.

"I am not real thrilled they are changing things around," Dionne said. "Windows 7 does everything I want it to. Where is the return on my investment to learn a new OS?"

Microsoft usually releases a new version of Windows every two or three years, but it's different this time around. Windows 8 is the most radical redesign of the operating system since 1995 and some analysts consider the software to be Microsoft's most important product since co-founder Bill Gates won the contract to build an operating system for IBM Corp.'s first personal computer in 1981. Microsoft is hoping the way Windows 8 looks and operates will appeal to the growing number of people embracing the convenience of smartphones and tablets.

The consumer ambivalence, however, was even more pronounced when it came to Microsoft's new tablet computer, Surface, which was built to show off Windows 8's versatility. Sixty-nine percent of the poll's respondents expressed little or no interest in buying a Surface, which Microsoft is hoping will siphon sales from Apple Inc.'s pioneering iPad and other popular tablets such as Amazon.com Inc.'s Kindle Fire and Google Inc.'s Nexus 7.

The results indicate Microsoft still has work to do to create a bigger buzz about Windows 8 and help consumers understand the new operating system's benefits, even though the company provided several previews of the software at various stages in the final 13 month leading to its release. But the information apparently resonated mostly with industry analysts, reporters, technology blogs and gadget geeks.

Microsoft is in the early stages of an estimated $1 billion marketing campaign that will include a siege of television commercials to promote Windows 8 to a wider audience.

That still might not be enough to sway longtime Windows users such as Mary Sweeten. She is 75, and not eager to learn the nuances of a new operating system. She, too, is comfortable with her current desktop computer running on Windows 7.

"I am not technologically savvy like all these young kids," said Sweeten, who lives in Camdenton, Mo. "I like something I am used to and can get around on without too much trouble. Sometimes when you get these new (systems), you wish you could go back to the old one."

Windows 8 represents Microsoft's attempt to adapt to a technological shift that is empowering more people to use smartphones and tablets to surf the Web and handle other simple computing tasks. The revamped system can be controlled by touching a device's display screen and greets users with a mosaic of tiles featuring an array of dynamic applications instead of the old start menu and desktop tiles. In an effort to protect its still-lucrative PC franchise, Microsoft designed Windows 8 so it can still be switched into a desktop mode that relies on a keyboard and mouse for commands.

Microsoft felt it had to gamble on a radical redesign to fend off the competitive threats posed by Apple, which has emerged as the world's most valuable company on the strength of its iPhone and iPad. Google Inc. is a threat, too. It has used its 4-year-old Android operating system to become an influential force in the mobile computing movement.

Despite the growing popularity of smartphones, Microsoft remains deeply entrenched in people's lives. The poll found 80 percent of respondents with personal computers in their homes relied on earlier versions of Windows versus only 12 percent that operating on Apple's Mac system.

Windows is even more widely used in offices, but 90 percent of companies relying on the operating system are expected hold off on switching to the new operating system through 2014, according to a study by the research firm Gartner Inc.

Jim Beske of West Fargo, N.D., won't be waiting long to install Windows 8 on the home computer he bought a year ago. He already has seen how Windows 8 works in his job as a network engineer, and he considers it to be a nice improvement.

"They have made it much simpler," Beske, 43, said. "I don't know about the tiling so much; that's something I think younger people will like more. But once people get in front of it, I think they will understand it."

Windows 8 also could appeal to consumers who still don't own a home computer. The AP-GfK survey found 22 percent of all adults fall into this category, including 30 percent with households whose incomes fall below $50,000 annually.

Beske is among a growing group who use both Microsoft and Apple products. Besides his Windows computer, he also loves his iPad.

Most survey respondents liked both Apple and Microsoft. Fifty-nine percent said they had favorable impressions of Apple versus 58 percent for Microsoft.

Tequila Cronk of Herington, Kan., is more of a Microsoft fan because she considers Apple's prices to be a "rip-off." At the same time, she can't justify buying a Windows 8 computer when her desktop and laptop computers at home are running fine on the earlier versions of the system.

"We will upgrade, but I am not going to rush out and buy a new computer just because it's got a different operating system," Cronk, 26, said.

Windows 8's release came at a perfect time for Hector Gonzalez of Kissimmee, Fla. He is so frustrated with the performance of his 3-year-old laptop running on Windows 7 that he is considering buying a MacBook laptop. But now he plans to check out the array of new Windows 8 laptops and may even consider buying a Surface tablet to supplement the iPad that he bought for his teenage daughters.

"Anything that is new, it's worth taking a look at," Gonzalez, 35, said. "That's the way technology is. There is always something new to replace everything else."

Mechanism found for destruction of key allergy-inducing complexes, researchers say

ScienceDaily (Oct. 28, 2012) ? Researchers have learned how a human-made molecule destroys complexes that induce allergic responses -- a discovery that could lead to the development of highly potent, rapidly acting interventions for a host of acute allergic reactions.

The study, published online Oct. 28 in Nature, was led by scientists at the Stanford University School of Medicine and the University of Bern, Switzerland.

The new inhibitor disarms IgE antibodies, pivotal players in acute allergies, by detaching the antibody from its partner in crime, a molecule called FcR. (Other mechanisms lead to slower-developing allergic reactions.)

"It would be an incredible intervention if you could rapidly disconnect IgE antibodies in the midst of an acute allergic response," said Ted Jardetzky, PhD, professor of structural biology and senior investigator for the study. It turns out the inhibitor used by the team does just that.

A myriad of allergens, ranging from ragweed pollen to bee venom to peanuts, can set off IgE antibodies, resulting in allergic reactions within seconds. The new inhibitor destroys the complex that tethers IgE to the cells responsible for the reaction, called mast cells. Severing this connection would be the holy grail of IgE-targeted allergy treatment.

The first time a potential allergen enters the body, some people respond by making allergen-specific IgE antibodies. These antibodies stick around long after the initial allergen is cleared from the body. Most of the antibodies get snagged by IgE-specific receptors called FcRs, which are exposed on the surface of mast cells. The mast cells are then primed to react the next time a person encounters the allergen.

Dissociation of this IgE-FcR interaction is a sought-after goal of allergy treatment for a good reason: IgE-coated mast cells are grenades of histamine, and re-encountering the allergen is equivalent to pulling out the clip. When an allergen makes a return visit, it binds to the pre-loaded IgE on the mast cell surface, triggering the release of inflammatory mediators -- including histamine -- that promote the allergic response. As allergy sufferers are well aware, these nasty reactions can occur within a matter of seconds. In a severe allergic response, sudden anaphylactic shock and death can be the result.

The key to actively disabling the allergic response lies in the separation of IgE from the FcRs on the surface of mast cells. But separating these dangerous couples is a tall order because their interaction is extremely stable -- sensitizing the mast cells for weeks. Currently available treatment using omalizumab (an anti-IgE antibody sold under the trade name Xolair) can block new interactions between IgE and FcR, but it is not designed to pry the molecules apart once they've formed a bond on the surface of a mast cell. So Xolair can dampen the allergic response, but as stated on the product's website: "Xolair is not a rescue medicine and should not be used to treat sudden asthma attacks."

While simply blocking IgE binding is helpful for some allergy sufferers, when it comes to the rapid quenching of an acute allergic response, "what you'd really like to do is get rid of it," said Jardetzky. Along with scientists at the University of Bern, his team discovered that an engineered protein inhibitor called DARPin E2-79 stripped IgE from the mast cell receptor. Using this inhibitor, "an interaction that normally lasts for hours or days in terms of its stability is stripped off in a matter of seconds," said Jardetzky.

DARPin E2-79 is one of a family of engineered inhibitors containing protein-binding regions called ankryin repeats. While Jardetzky's group was using structural biology and biophysical approaches to probe the weak spots in the IgE-FcR interaction, scientists at the University of Bern were tinkering with DARPins that dampened IgE's disastrous effects. The collaboration of the two groups resulted in the characterization of DARPin E2-79, an inhibitor that goes beyond mere blockade to actively disassemble the IgE-FcR power couple.

Jardetzky's group solved E2-79'S structure and used this information to model its interaction with the IgE-FcR pair. Then, using sensitive biochemical techniques that detect step-by-step binding interactions between molecules, the teams were able to tease out the mechanism that the inhibitor uses to break the IgE-FcR bond.

The researchers found that E2-79 hastens the separation of the two molecules by taking advantage of a moment of weakness in the relationship between IgE and FcR. IgE maintains its interaction with FcR using two contact points, and occasionally one of these points releases while the other one keeps the pair together. Normally this brief looseness isn't enough to separate the couple, but E2-79 can swoop into the small space between them, effectively driving the couple apart.

While E2-79 is the first molecule to display these IgE stripping characteristics, Jardetzky hopes that this work will stimulate the discovery of smaller compounds capable of working even more efficiently. Drug developers generally expect large macromolecules like E2-79 to be less potent than small molecule inhibitors and unlikely to be able to disrupt complexes, so the fact that E2-79 worked so well was a surprise. Small molecules are more amenable to oral administration, and are easier and cheaper to manufacture than large macromolecules. "Now we're in the hunt for a small molecule that could have this kind of activity. That would be the real hit," said Jardetzky.

The discovery of E2-79's mechanism of IgE inhibition could lead to rapid discoveries from other labs as well. Now that scientists know what mechanism to look for, they may be inspired to dig back through freezers full of IgE inhibitors that were identified years ago, said Jardetzky. In the light of techniques described in this study, perhaps once-neglected inhibitors will show new promise in the treatment of allergic disease.

The study's primary authorship was shared between Beomkyu Kim, PhD, a Stanford graduate student, and Alexander Eggel, PhD, at the University of Bern. The other Stanford co-author is research assistant Svetlana Tarchevskaya.

The study was funded by the National Institutes of Health, the American Asthma Foundation and the Swiss National Science Foundation.

The Conspiracy of Failed Integration ? Uncreated Light

[1]Jared Taylor?s ?Paved with Good Intentions[2], was a real eye-opener. Taylor says,

?In 1954, when the Supreme Court heard the case of Brown v. Board of Education, no one asked for or dreamed of forced integration, racial quotas, or busing. The main plaintiff in the case, Oliver Brown, was not an activist. All he wanted was to send his daughter, Linda, to the white school just seven blocks away, rather than across town to the ?colored? school.?[3]

However, as Taylor points out, ?The Civil Rights Act [1964]?did not require schools to move students around to achieve racial balance. Once again, this did not stop the nations? courts from making school districts do exactly the opposite of what Congress intended. The original idea behind school desegregation was that it was impossible for schools to be ?separate but equal.??

?In Hobson vs Hanson (1967), and in response to persuasive?expert opinion. Judge? J. Skelly Wright stated ?Racially and ?socially homogeneous schools damage the minds and spirits of ?all children.?[4] On the contrary, ?when we examine documents from the OECD, PISA 2009 Database we find that the top performers in Education are highly homogenous nations, such as China, Japan and Korea.[5]

The justification for forced busing leaned on this idea that black children simply could not learn unless they were sitting next to white children. What we have come to realize is that the dominate result of integration is not an educated black demographic but a dumbed down, savagized and negro-ized white demographic. I currently have a friend who teaches in the Public School system, and is completely exasperated with the behavior of black children and their destructive influences on white children [Could this be the real purpose for integration?].

This comes at no surprise because originally neither the black community nor the white community approved of forced busing and forced racial balancing in public schools.? Taylor points out, ?A Gallup Poll taken [in 1973]?showed that only 4 percent of whites and 9 percent of blacks approved of busing.?[6] [See also the image above]

Moreover, the forced busing has accomplished the exact opposite goal it was supposedly created for. Taylor points out,

?In June 1989 there were 3,436 black children waiting to get into these magnet schools [Kansas City, MO], but to admit them would tip the ratio past the 60:40 limit. The school board virtually? begged whites to enroll, but only 79 accepted. This meant a few more blacks could be taken, but it still left thousands out in the cold. There were places in magnet schools going begging, but since? integration was seen as more important than education, black children could not have them. 757 Just as Oliver Brown did in 1954,?black parents filed suit because they were being kept out of good neighborhood schools on account of their race.?[7]

There is no surprise that we have the same problem today.[8]Taylor points out that Judges have desperately attempted to improve these schools in order to draw in more white students at the expense of insane and illegal property taxes. But as we have seen since the African Slave Trade-Jesuit Race War conspiracy the Race War against the White Protestants takes precedence over all, and the taxes have passed. Hypocrites!

Not only has the Integrationist Yankee Race War shown itself hypocritical, its alleged primary goal, the educational improvement of the black race pursuant unto racial equality, has failed. In the 2002, Beyond the Color Line: New Perspectives on Race and Ethnicity in America by the Thernstroms we read,

?The debate over desegregation and achievement has continued unabated since the early 1970s, when the first evidence appeared that desegregation was not improving black achievement. In spite of the claims and expectations of many supporters of desegregation during the 1960s, and in spite of the existence of comprehensive and well-funded desegregation plans in many school districts throughout the nation, there is not a single?example in the published literature of a comprehensive racial balance plan that has improved black achievement or that has reduced the black-white achievement gap signi?cantly.?[9]

This is why the dumbing down of our educational system is so important to our Yankee Federalist Government.? In order to meet requirements on standardized tests, many Schools throughout the country have resorted to all-out cheating according to a Washington Post article, Ed Dept. seeks ways to stem cheating on standardized tests?by?Valerie Strauss.[10]

Could it be that the purpose of Integration and racial equality was not the long term benefit of the blacks but the long term detriment of the whites? Could it be that our government knows that the blacks will never be equals with whites and knows that integration has failed and never intended it to succeed? Could it be that that White Anglo Protestant Robert Lewis Dabney was correct when he said in his Defence of Virginia,

?But while we believe that ?God made of one blood all nations of men to dwell under the whole heavens,? we know that the African has become, according to a well-known law of natural history, by the manifold influences of the ages, a different, fixed species of the race, separated from the white man by traits bodily, mental and moral, almost as rigid and permanent as those of genus. Hence the offspring of an amalgamation must be a?hybrid race, stamped with all the feebleness of the hybrid, and incapable of the career of civilization and glory as an independent race. >> well, good morning to you, guys. so far sandy has been a deadly storm, first hitting cuba. at least 21 people dead there. we've also had reports of at least one person killed in jamaica as that system moved through, roaring through there as a category two storm. now it is hitting the bahamas , central bahamas , where there are hurricane warnings up. this is the latest on sandy. let's give you the statistics. right now sandy is still a category 1 storm. it's currently 210 miles east of miami, florida , 80-mile-per-hour winds. it's moving northwest at 13. right now hurricane warnings are up for all of the bahamas , a good portion of the bahamas , the central bahamas at least. we're looking at tropical storm warnings from ocean reach, florida , all the way up to flagler beach . tropical storm watch is north of there, and as we make our way into the southeast from the savannah river to the oregon inlet , along the carolinas, we now have tropical storm watches. here's what we look for as far as sandy's path. we're expecting, this is from the national hurricane center . it makes its way across the bahamas today and kind of parallels the florida coast. by friday afternoon. then it makes a bit of a right turn saturday. we have two models we look at, the gfs which is the american model and the european model. that's put out by the european hurricane organization, and by monday morning the european model is much closer to the shore and comes in on land somewhere just south of the delmarva peninsula , while the american model comes in closer up to new york . and that's going to make a big difference. if it comes in closer to new york , that means the new york and the metropolitan area is going to be in the worst quadrant of the storm, massive flooding, storm surge , he have rain and strong winds. if we say with the european model, it's more about the mid-atlantic states and heavy snow back through the appalachians. we'll know better later today when both models have the latest run and in the meantime everybody from the carolinas to new england have to watch for this very dangerous storm. it could be an unprecedented one. matt?

Why Amnesty Should Lose at the Supreme Court

The Supreme Court will hear argument Monday in a case designed to put some Bush-Obama terror-related surveillance policies on trial. Brought by Amnesty International and other public-interest groups, the challenge reflects post-9/11 anxiety about an out-of-control executive branch, and, even more, a fantasy that courts will do anything about it. They won?t, and that?s a good thing.

In 1978, Congress passed the Foreign Intelligence Surveillance Act, which attempted to regulate the president?s use of wiretapping for national security purposes. In order to conduct surveillance of a ?foreign power? or its agents when their communications travel to or from the United States, federal officials would generally be required to obtain a warrant from the secret Foreign Intelligence Surveillance Court. In trying to cast a wide net, the Bush administration may have violated this statute, as Steve Vladeck suggests, since the law requires the government to specifically identify the surveillance targets. To address this problem, Congress in 2008 passed the FISA Amendments Act, which authorizes the U.S. government to engage in mass surveillance abroad. The government may not intentionally target Americans (at home or abroad), or foreigners in the United States, but the law does not prohibit spies from reading communications between lawful targets and Americans who are inadvertently swept into the net.

Amnesty argues that this provision of the 2008 amendments violates the Fourth Amendment, which protects people from unreasonable searches. Monday?s case, called Clapper v. Amnesty International, does not tackle this question. The trial court dismissed Amnesty?s complaint not for any reason involving the Fourth Amendment, but rather because Amnesty lacked standing to challenge the warrantless wiretapping at issue. The Court of Appeals overturned the trial court?s decision, and now the Supreme Court must decide whether Amnesty may bring this lawsuit.

Standing is a famously messy area of the law. Reduced to its essentials, it means that a plaintiff may sue a defendant only if the plaintiff has suffered an injury at the defendant?s hands. ?Suppose that the police beat you up. You have standing to sue and recover damages. But suppose that you do not sue because you fear police retaliation. Could a bystander, fired by indignation that the police will escape punishment, sue instead? The answer is no: The bystander lacks standing because he did not suffer any injury. His suit gets thrown out.

Standing doctrine is said to come from Article III of the Constitution, which provides that the judicial power extends to ?cases? and ?controversies,? but courts during the founding era employed a looser notion of standing than they do today (and indeed did not even use the word).? Back then, people brought cases against lawless executive branch officials, and the Supreme Court didn?t object that they themselves had not been harmed. This began to change during the New Deal, when progressive justices thwarted challenges to FDR?s new agencies by denying standing to people who objected to them on ideological grounds. In the 1950s and 1960s, liberal justices reversed course and relaxed standing requirements, so that public interest groups could sue agencies and compel them to regulate properly. Then starting in the 1970s conservative justices started to tighten the rules for getting into court.?

In a famous case decided in 1992, the Supreme Court rejected a lawsuit brought by environmental organizations that challenged the government?s failure to apply the Endangered Species Act to overseas projects financed by government agencies. The groups claimed that some of their members planned to go overseas and might not be able to observe endangered animals like the Nile crocodile if the statute were not applied abroad. The court shed crocodile tears but held that the animal-loving plaintiffs lacked standing because their injury was not ?actual or imminent.? The court treated the environmental groups like the bystander, motivated by an ideological goal rather than the desire to obtain redress for a real harm they?d suffered. The case shows how the law of standing can prevent people from challenging government actions that may be illegal, but don?t directly affect them.

Jailers worry about dental floss as a weapon

(AP) ? Dental floss may prevent toothaches, but it's given jailers plenty of headaches.

When a group of New York prisoners sued last month to demand access to dental floss, officials said they had to consider "security issues." As it turns out, jail ? and jailbreak ? history is tightly tangled with the stringy decay fighter.

In Texas, officials believe a prisoner used floss to cut his way out of his cell, then jumped a fellow inmate and knifed him to death.

In Maryland, Illinois, West Virginia and Wisconsin, inmates collected enough floss to braid it into ropes and escape, or try to, over prison walls.

A group of escaped prisoners on the run in Texas used floss to sew up their gunshot wounds.

And a man in an Illinois jail used floss to stitch together the dummy he left in his bed when he took off.

Experts say floss, or the plastic holder it sometimes comes in, has been used to strangle enemies, to escape, to saw through bars, to pick handcuffs, to make a hand grip on a shank and to hoist contraband from one level of cells to another.

"These inmates can make a weapon out of a chewing gum wrapper," said Steven Kayser, whose company sells a floss product advertised as prison-safe. "Floss is right up there on the danger list."

Officials at the Westchester County Jail in Valhalla were somewhat leery when 11 inmates, acting without a lawyer, filed a $500 million lawsuit demanding access to dental floss.

Lead plaintiff Santiago Gomez said the jail was "violating inmates' federally protected civil rights by not allowing inmates access to dental floss, while acknowledging that it will result in cavities if you fail to floss your teeth."

He said the inmates had been brushing three times a day, "tongue and gums included," but were still getting cavities, bleeding gums, enduring constant tooth drilling and mental anguish.

Deputy Commissioner Justin Pruyne said the jail is not required to supply floss to inmates and said floss posed security concerns. But the jail has since brought in a supply of Kayser's "Floss Loops" ? circles of rubbery floss with no hard plastic that are designed to break easily before they can be used as a weapon.

It's not clear if that has satisfied the prisoners. The lawsuit has not been dropped.

An episode of the science TV show "Mythbusters" a few years ago set up an experiment to challenge the floss-as-security-risk theory. The show used a floss-equipped robot to test whether floss ? combined with toothpaste to make it more abrasive ? could really saw through a bar on a jail cell.

The feat was declared "plausible," given 300 days at eight hours a day ? the kind of time that an inmate might have.

Regulations of prison floss vary around the country.

In northeastern Texas, officials believe Antonio Lara used dental floss and toothpaste to saw his way out of a cell at a county jail and kill a gang rival in 2000.

"We do not carry traditional dental floss because of security concerns," said Jason Clark, spokesman for the Coffield Unit near Palestine, Texas. "Floss can be used to make ropes, weapons, cut through bars, even just reinforce the grip on a shank."

Instead, inmates are allowed plastic holders with a small piece of floss stretched across, he said.

In California, the state approves Floss Loops. Regular floss can be used as a garrote, said Terry Thornton, spokeswoman for the California Department of Corrections and Rehabilitation.

"But for that matter, you can pull thread from your socks or bed linens to choke someone. It's not just razor blades and toothbrush shanks in prison. We've seen underwear used as a weapon."

New York's state prison system permits dental floss, but only the unwaxed variety. The waxed is "much stronger," said spokesman Peter Cutler. He said prison security officials have banned it after having "experience" with the waxed variety. He would not elaborate.

The Westchester jail does ban toothpicks and water picks; inmates are allowed to have a 3-inch-long toothbrush, Pruyne said. Kayser said he also makes a "rubber-type" flexible toothbrush that's 4 ? inches long, but said anything longer could be fashioned into a weapon.

It was waxed floss that was used in Wisconsin in 1997 by inmates Timothy Dummer and Guy Dunwald. They used ropes of braided floss to get over a wall at the Green Bay Correctional Institution. They were quickly recaptured and had five years added to their sentences.

A television story about the episode said the prisoners had collected 18,975 feet ? more than 3? miles ? of dental floss.

In 1994, Robert Shepard used a floss rope braided as a telephone cord to scale an 18-foot wall at the South Central Regional Jail in West Virginia. He was on the lam for about five weeks. He was already being disciplined for scraping away the mortar between bricks in his cell.

In 1991, three inmates bought hundreds of yards of dental floss from the store at the Hays County Jail in Illinois and turned it into a ladder of sorts.

"It was ingenious," said U.S. Attorney Gerald Carruth when the men pleaded guilty to attempted escape. "They made the rope out of dental floss and used cardboard salt-and-pepper containers for stirrups on the ladder. ... That dental floss is strong."

USA Developing Legal Drama From Barry Schindel And David ...

EXCLUSIVE: Law & Order alum Barry Schindel is back on the legal beat with Shadow Counsel, a drama for USA Network. Schindel is writing/executive producing and David Semel is directing/executive producing the project, from Universal Cable Prods. It centers on a former Army lawyer who, in order to crack an ongoing investigation, is recruited reluctantly by the FBI as a Shadow Counsel ? a ?secret? lawyer who operates in the shadows, completely off the record to circumvent existing roadblocks (hired attorneys, interrogators, etc) in classified cases.

A former trial attorney for the New York City Legal Aid Society, Schindel segued to writing/producing and served as co-chairman of Gotham-based Kardana Films. He spent three years on Law & Order, rising to executive producer/showrunner. CAA-repped Schindel has done a couple of legal drama pilots, including NBC?s adaptation of Rex Is Not Your Lawyer, which also was directed by Semel.

WME-repped Semel was recently tapped to direct Howard Gordon?s TNT drama pilot Legends. He has directed the pilots for such series as American Dreams, Heroes, No Ordinary Family and CBS? Person of Interest.

Snack Recipe: Cheesy Yet Vegan Kale Chips Recipes From the Kitchn

I tried to make kale chips a few years ago when a friend told me how much she swears by this simple, healthy snack. A bad oven and an impatient cook (guilty!) burned them just a little bit. And you know what? They were terrible! But, after tasting some incredibly flavored dehydrated kale chips, I made it my mission to try again and to make them successfully at home ? but without a dehydrator. And you know what? It worked! Here's your ticket to healthy-style Doritos. Seriously.

KaleChips5.jpgIf you're fortunate enough to have the pantry space for a dehydrator, then you can just skip the oven directions here and go about your merry way. For those of us who have to rely on an oven to do the trick, it's no surprise that the key is keeping the temperature very low. As in as low as your oven will go. And prepare to wait it out for a few hours while these chips dry out.

The wait is worth it, however. Somehow, the hodgepodge of ingredients come together to taste, well, cheesy. In a good way. Think of these as your healthy Doritos, and they'll disappear as quickly.

Cheesy Kale Chips

Serves 2 to 4 as a snack

3/4 cup cashews
1 bunch kale, washed and dried
1/2 red bell pepper, stem and seeds removed, chopped into large pieces
1 clove garlic, peeled
1 tablespoon soy sauce
2 tablespoons vegetable oil
1/3 cup nutritional yeast (not to be confused with Brewer's yeast)
1 lemon, peeled, cut into wedges, and de-seeded as much as possible (a few stragglers are ok)

Cover the cashews with water in a small bowl and let the soak for at least one hour before proceeding.

Preheat oven to the lowest heat setting (mine is 180 degrees). Line several baking sheets with parchment paper. Drain cashews and set aside. Trim stems the from each kale leaf and cut each leaf into chip-size pieces.

Blend the cashews, red pepper, garlic, soy sauce, oil, nutritional yeast, and lemon in a food processor until smooth. In a large bowl, combine kale and cashew paste, making sure kale is evenly coated. Place kale pieces on baking sheets allowing space between each piece so they do not touch or overlap. This will take more than one batch, so reserve any remaining kale and refrigerate, covered, until first batch has finished baking.

Bake kale until crisp and completely dry, between 2 and 4 hours. Check after the first hour and turn leaves over. Check kale periodically. Chips will be ready when crunchy and stiff and topping doesn't feel chewy or moist.

Kale chips will keep in an air tight container for one week.
